These terms govern your use of MudWheelz.ca. By creating an account, posting a listing, submitting a form or
simply browsing the site, you agree to them. If you do not agree, please do not use MudWheelz.
In short: we are a marketplace and an information site. We connect buyers, sellers and dealers, and point you
toward financing, insurance and inspection partners. We do not own, sell, inspect or guarantee any
machine listed here, and any transaction is between you and the other party.
1. What MudWheelz Is, and Is Not
MudWheelz is an online marketplace and information site for off-road and powersport vehicles in Canada. We
provide the platform where sellers list machines and buyers find them.
We are not:
- A dealership. We do not own, hold, sell or ship any vehicle.
- A party to any sale. Transactions are directly between buyer and seller.
- A lender, insurer or broker. We pass your enquiry to partners who are.
- An inspector or mechanic. Inspections are carried out by independent third parties.
- An escrow or payment service. We never handle your money.
Because we are not a party to any sale, we cannot guarantee any listing, any seller, any machine, or the
outcome of any transaction. Your own checks matter.
2. Accounts
- You must be at least 13 to create an account, and at least 18 to apply for financing.
- Give accurate information and keep it current. Buyers rely on your city, province and contact details.
- One person, one account. Do not create accounts to impersonate someone else or to evade a suspension.
- You are responsible for your password and for everything done through your account.
- Tell us immediately at info@mudwheelz.ca if you think your account has been accessed by someone else.
3. Listings and Selling
Listing on MudWheelz is free. When you post, you confirm that:
- You own the machine or part, or are authorised by the owner to sell it.
- The description, condition, hours, mileage and price are accurate and not misleading.
- The photos are of the actual item, and you have the right to use them.
- The item is legal to sell and is not stolen, and any lien is disclosed.
- You will respond to genuine enquiries in a reasonable time.
- You will mark the listing as sold or remove it once it is no longer available.
Not allowed: stolen goods, listings for machines you do not have, bait pricing, duplicate
listings for the same item, misleading titles, contact details or links in photos, or listings placed only to
advertise another site or service.
We may edit, decline or remove any listing at our discretion, particularly where it appears fraudulent,
unsafe, misleading or in breach of these terms.
4. Buying and Your Own Due Diligence
Listings are created by sellers, not by us. We do not verify machines, inspect them, confirm ownership, or
check for liens before a listing appears. That is your responsibility as a buyer.
Before you pay for anything: see the machine in person, match the VIN on the frame to the
ownership document, run a lien search, insist on a cold start and a test ride, and never send a deposit or
e-transfer to someone you have not met. If a deal feels rushed or the price seems too good, walk away.
Our free inspection checklist and
buying guides exist to help, but they are general guidance, not
a substitute for your own inspection or professional advice.
5. Financing, Insurance and Inspections
When you submit a financing application, insurance quote request or inspection request, we pass your details
to Canadian partners who provide those services. We do not approve credit, issue policies or perform
inspections ourselves.
- Any rate, term, premium or price you are quoted comes from that partner, not from us.
- Approval is at the partner's discretion, and submitting a form is not an offer or guarantee of credit.
- Figures shown in our payment calculator are estimates for planning only, not an offer.
- Any agreement you enter is between you and that partner, on their terms.
How we are funded: we may receive a referral fee or commission from a partner if you go on to
complete a financing agreement, insurance policy or inspection. This does not change what you are quoted, and
we tell you so you understand our position.
6. Dealers
- Dealer accounts are reviewed and approved by us before going live, and approval can be withdrawn.
- The verified badge means we reviewed the business. It is not a warranty, an endorsement of any machine, or a guarantee of any transaction.
- Dealers must hold any licence their province requires and comply with applicable consumer protection law.
- Dealer inventory must be genuinely available, accurately described and priced as advertised.
- Where a dealer authorises us to list inventory on their behalf, the dealer remains responsible for its accuracy.
- Dealers must handle buyer enquiries and personal information responsibly and lawfully.
7. Content You Submit
This covers listings, photos, articles, trail submissions, messages and anything else you post.
You keep ownership of your content. By submitting it, you grant MudWheelz a non-exclusive,
royalty-free licence to host, display, reproduce and distribute it for the purpose of operating and promoting
the site, including in search results and on our social channels. You can end this licence for future use by
deleting the content, though copies may remain in backups or caches for a period.
You confirm that your content:
- Is yours, or you have permission to use it. Do not copy photos or text from other listings or websites.
- Is accurate and not misleading.
- Does not infringe anyone's copyright, trademark or privacy.
- Is not unlawful, hateful, harassing, obscene or otherwise inappropriate.
- Does not contain another person's contact details without their consent.
Articles and trail submissions are reviewed before publishing, and we may edit them for accuracy, length,
clarity or style. We may decline or remove any submission.
8. Trail Information and Riding Risk
Our Trail Finder is a community resource. Trail details come from riders and public sources, and conditions,
access rules and permit requirements change constantly.
Off-road riding is inherently dangerous. You are responsible for confirming that a trail
is open and legal to ride, that your machine is registered and insured as your province requires, and that
you hold any permit needed. Always confirm with the local club or provincial authority before you ride, and
ride within your ability.
We do not own, maintain, inspect or control any trail listed, and we make no guarantee that any trail is
accurately described, currently open, safe, or legal for your vehicle type. You ride entirely at your own risk.
9. Things You Must Not Do
- Post false, fraudulent, misleading or scam listings.
- Impersonate another person, business or dealership.
- Harass, threaten or abuse other users, or send unsolicited commercial messages.
- Scrape, crawl, harvest or bulk copy listings, contact details or any other content from MudWheelz.
- Use automated tools, bots or scripts against the site, or attempt to bypass rate limits or security.
- Attempt to gain unauthorised access to accounts, servers or data.
- Upload malware, or anything designed to damage or interfere with the site.
- Use contact details obtained here for marketing unrelated to the listing.
- Resell, redistribute or republish our content without written permission.
10. Our Intellectual Property
The MudWheelz name, logo, site design, original written content, tools and code are owned by MudWheelz and
protected by Canadian and international law. You may not copy, reproduce or reuse them without our written
permission.
Manufacturer names, model names and logos mentioned on the site belong to their respective owners and are used
only to describe the machines. MudWheelz is not affiliated with, endorsed by, or sponsored by any manufacturer.
If you believe content on MudWheelz infringes your copyright, contact
info@mudwheelz.ca with details and we will investigate promptly.
11. Disclaimers and Limits of Liability
MudWheelz is provided on an "as is" and "as available" basis. We work hard to keep it accurate and running,
but we do not guarantee that the site will be uninterrupted, error free, or that any information on it is
complete or current.
To the fullest extent permitted by law, MudWheelz is not liable for:
- Any transaction, dispute, loss or damage between a buyer and a seller or dealer.
- The condition, safety, legality, description or value of any machine or part listed.
- Any decision, rate, premium or outcome from a financing, insurance or inspection partner.
- Injury, damage or loss arising from riding, including on any trail listed here.
- Any loss arising from content submitted by other users.
- Interruptions, downtime, data loss or technical failure.
Nothing in these terms limits liability that cannot be limited under Canadian law, including consumer
protection rights that apply to you.
12. Suspension and Termination
We may suspend or close an account, or remove listings and content, where we believe these terms have been
breached, where activity appears fraudulent or harmful, or where required by law. Where it is reasonable to do
so, we will tell you why.
You can close your account at any time by contacting us. Sections that by their nature should survive, such as
intellectual property, content licences and limits of liability, continue to apply afterwards.
13. Governing Law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Any dispute will be dealt with by the courts of
Alberta, without affecting any consumer protection rights you
have in your own province or territory.
14. Changes to These Terms
We may update these terms as the site develops or as the law changes. The date at the top shows when they
were last revised. If we make a significant change, we will give notice on the site or by email. Continuing to
use MudWheelz after a change means you accept the updated terms.
